1. Nature of Our Services
Varalix Digitech Solutions provides bespoke, project-based software, AI, and consulting services. Engagements are delivered under a written Statement of Work ("SOW") agreed between you and us. Because the work is custom and time-and-effort based, the terms in this policy apply alongside — and are governed by — the specific commercial terms set out in your SOW.
2. Payments and Milestones
Unless your SOW states otherwise:
- Project work is billed against agreed milestones or monthly periods, not entirely in advance.
- An initial booking or advance payment may be required to reserve capacity and begin work.
- Each milestone payment covers the work performed and resources committed up to that point.
3. Cancellation by You
You may cancel an ongoing engagement by written notice. On cancellation:
- You are charged for all work completed and any non-recoverable costs or third-party commitments incurred up to the cancellation date.
- Any amount you have paid that exceeds the value of work delivered and committed costs is refunded to you.
- Initial booking or advance amounts are non-refundable to the extent work has begun or capacity has been reserved, as set out in your SOW.
4. Cancellation by Us
If we are unable to continue an engagement for reasons within our control, we will refund any amount you have paid for work not yet delivered. We are not liable for delays or non-performance caused by factors outside our reasonable control, by incomplete or inaccurate information provided by you, or by your failure to meet agreed dependencies.
5. Deficient Service
If a delivered milestone does not meet the agreed specification in the SOW, we will correct it at no extra cost within the scope of that SOW. This is your primary remedy. Nothing in this policy limits any rights you have under applicable Indian consumer protection law.
6. How Refunds Are Processed
Approved refunds are made to the original payment method, or by bank transfer where that is not possible, normally within 7–14 business days of approval. Any payment-processor or bank charges, and applicable taxes already remitted, may be adjusted from the refunded amount where permitted by law.
7. Requesting a Refund
To request a cancellation or refund, contact us in writing at the address below. Please include your engagement reference and the reason for the request so we can resolve it quickly.
8. Governing Terms
This policy is governed by the laws of India and should be read together with our Terms of Service and your signed Statement of Work. Where the SOW and this policy differ, the SOW governs the specific engagement.
